Fusion Orthopedics wins patent judgment against Extremity Medical

Fusion Orthopedics has won a patent judgment against Extremity Medical from the U.S. Patent and Trademark Office's Patent Trial and Appeal Board. 

The board found that 14 patent claims brought by Extremity were invalid and denied motions to amend the claims of the '166 patent, according to a Nov. 5 news release from Fusion. 

Any efforts by Extremity Medical to continue asserting patent claims will be held as sanctionable, according to the release. 

Extremity Medical filed the '166 patent in 2021 targeting the IntraLock, which launched in 2019. Subsequently, Extremity Medical filed a bad faith patent infringement lawsuit on April 28, 2023.

Extremity Medical has sought to enforce invalid patent claims within the ‘166 Patent Family against Fusion Orthopedics, Zimmer Biomet and Paragon 28. 

Extremity Medical was sanctioned in the amount of $52,573 for pursuing claims against Zimmer Biomet. Fusion Orthopedics will likely seek similar monetary relief against Extremity Medical, the release said.
