In June, hip replacement patients represented by an alliance of law firms filed the first lawsuit over DePuy Orthopeadics' recalled ASR hip replacement, according to a news release.
The lawsuit, filed in in Ft. Myers, Fla., alleges the ASR hip replacement design, for the patient's bone to grow into the back of the cup, was defective. ASR hip replacement recipients complained of loosening due to their bone's failure to grow into the cup at a high rate. Thus, DePuy warned physicians about the complications and phased the product out.
However, in addition to claiming defective design, the lawsuit claims DePuy knew the ASR replacements were failing at a high rate and did not relay this information to consumers or orthopedic surgeons in a timely fashion.
DePuy does not comment on pending legal matters, according to MassDevice.
