Smith & Nephew has agreed to drop the lawsuit against Central Texas Orthopedic Products, a distributor for rival Biomet, according to a Mass Device report.
Smith & Nephew filed the lawsuit last August, accusing the distributor of poaching its sales representatives. The suit alleged Central Texas knew Nick Garrett, a former Smith & Nephew employee, was unable to work for the company due to a non-compete clause yet hired Mr. Garrett anyway.
A U.S. District Court in western Texas dismissed the case in July, and now both parties have agreed to drop the suit.
