Stryker moved to dismiss a lawsuit filed against its Accolade hip replacement system, according to Harris Martin.
Here are four notes:
1. Stryker is challenging the plaintiff's allegations as to whether the facts are sufficient to state claims for relief. The plaintiff alleges the implant was defective.
2. The motion was filed on July 7 in the U.S. District Court for the Northern District of California.
3. Stryker additionally claims the plaintiff's claims for punitive damages fail to meet those requirements outlined in California law.
4. The plaintiff received the hip prosthesis more than three years ago.
