Medtech company RSB Spine is suing medical device company Orthofix, which merged with SeaSpine, and alleging patent infringement related to four implants.
RSB Spine's lawsuit focuses on its InterPlate implants for cervical and lumbar spinal fusions, according to court documents filed Oct. 26 in the U.S. District Court for Eastern Texas. Its patent for the technology is called "Bone Plate Stabilization System and Method For Its Use."
In 2019, RSB Spine sent notices to Orthofix and SeaSpine with examples of alleged patent infringement. The implants under scrutiny are the LoneStar cervical standalone system, Complete Cervical interbody fusion device, Shoreline system and Meridian with Reef A system.
Orthofix denied patent infringement, and ongoing discussions haven't led to agreements. SeaSpine responded to RSB Spine and indicated its "unwillingness to engage in meaningful licensing discussions," the lawsuit said.
RSB Spine has successfully enforced its patent against other devicemakers such as DePuy Synthes in the past.
RSB Spine is asking for a jury trial. Orthofix didn't immediately respond to a request for comment from Becker's.
