Patent verdict supporting Globus Medical upheld

A judge has upheld a 2023 patent infringement verdict in favor of Globus Medical, according to Aug. 13 court documents filed in the U.S. District Court for the Eastern District of Pennsylvania.

In November 2019, the Moskowitz Family, which holds spinal fusion implant patents, sued Globus Medical alleging direct and indirect infringement. A jury in December 2023 ruled that the Moskowitz Family didn't meet "burden of proving, by a preponderance of the evidence, infringement by certain of [Globus Medical's] accused products of specified claims" for the three patents in its lawsuit.

The Moskowitz Family's motion for a new trial was denied. An order said that jurors followed instructions properly and there wasn't "indication that the jury misunderstood the law."

A spokesperson for Globus Medical didn't provide comment on the pending litigation.
